How Indiana’s Judicial Foreclosure Process Works in Hendricks County
Indiana is a judicial foreclosure state. That means a lender can’t schedule a sheriff’s sale without first filing a lawsuit and obtaining a court judgment, under Indiana Code 32-29-7 and 32-30-10. For Plainfield homeowners, that lawsuit is filed in the Circuit or Superior Court of Hendricks County, located at the courthouse in Danville.
Once you’re served with a foreclosure summons and complaint, you have a limited window to file a written answer with the court. Indiana law also gives you the right to request a settlement conference with your lender within 30 days of being served, under Indiana Code 32-30-10.5-8. Federal mortgage servicing rules generally prevent a servicer from initiating foreclosure until a loan is more than 120 days delinquent, but once that threshold is crossed and the complaint is filed, the timeline moves quickly.
From Judgment to Sheriff’s Sale: What Happens Next
Under Indiana Code 32-29-7-3, a court generally can’t order a sale until at least three months after the complaint was filed. Before the sale, the sheriff must publish notice once a week for three successive weeks, with the first publication at least 30 days before the sale date. That publication window is real time you can use.
Before the sale occurs, you may redeem your property by paying the full judgment, interest, and costs, under Indiana Code 32-29-7-7. Indiana law doesn’t provide a redemption period after the sheriff’s sale, so once the sale happens, that option is gone. If the sale price falls short of what you owe, the lender may in some circumstances pursue a deficiency judgment against you for the remaining balance.
How Chapter 7 & Chapter 13 Bankruptcy Interact with Foreclosure
Filing bankruptcy generally triggers an automatic stay, a court order that pauses most collection activity, including a pending foreclosure. What happens after that depends on which chapter you file and your specific circumstances.
Chapter 7 Bankruptcy
The automatic stay can halt a foreclosure in progress, though a mortgage lender can ask the court to lift it. Chapter 7 doesn’t provide a mechanism to catch up on missed payments, so it’s more useful when the goal is buying time or addressing other debts rather than keeping the home long term.
Chapter 13 Bankruptcy
Chapter 13 is a three-to-five-year repayment plan that lets you catch up on mortgage arrears in structured installments while continuing to make your regular mortgage payment. For homeowners who want to stay in their home, this is often the chapter worth examining closely.
We compare both options against your income, assets, arrears amount, and goals. Our aim is to help you see clearly whether bankruptcy fits your situation, not to steer you toward any particular outcome.
