Advantages to Filing with Your Spouse

There are advantages to filing jointly. One is that the fees connected with filing for bankruptcy are the same for joint or separate filings, so filing jointly is less costly. Another advantage is that if one spouse contributed to the debt, but declined to file bankruptcy with the other spouse, creditors could pursue the non-participating spouse for payment of the debt. In this case, if they filed jointly, both would be protected. Also, the amount of exemption for property owned by both parties can be doubled if the spouses file jointly.

It is also more efficient to file jointly as opposed to separately. Sometimes, however, filing jointly can be a disadvantage or not possible. A bankruptcy can be a deterrent to employment opportunities, including needed security clearings in some occupations. Also, if one spouse has an earlier bankruptcy, it may be impossible for that spouse to file again at this time. A spouse will not be able to file Chapter 7 if it's discovered fraud or concealment occurred, and could prevent debt from being discharged.
